Connie Marie Flores is an actress who has recently appeared in the Oscar-Nominated Netflix film Marriage Story and was credited in My Inspired World (2019) and What Bitch? (2019).
A lawsuit has been filed by Law Offices of Aksana Moshaiv Coone located in Los Angeles, California. The lawsuit, Connie Flores and Alvin Flores v Princess Cruise Lines (2:2019cv09961), filed in US District Court in the Central District of California, was filed on November 20, 2019, seeking general damages of at least $75,000 on multiple counts under both maritime and California law, including negligence, intentional infliction of emotional distress and battery, among others. The lawsuit claims the cruise line either knew or should have known about the alleged infestation and failed to treat it.
In a statement, Princess Cruise Lines said it was “very sorry” to hear about Flores’ allegations and said it was “committed to following and often exceed stringent sanitation and health guidelines.” Princess Cruise Lines said, and it would be “highly unusual” for the staff to not notice bed bugs. “It would be highly unusual for the presence of bed bugs to go unnoticed for more than the length of one cruise,” the statement added. “Given that this is an open lawsuit, we are limited in what information we can share right now,” the statement added, “however it is worth noting, our room attendants are highly trained to identify bed bugs and ALL staterooms are thoroughly inspected each month as a preventative measure.”
The lawsuit stems from a cruise that Flores and her husband Alvin took aboard the Princess Cruises Ship Emerald Princess between November 29 and December 4, 2018. Video footage was taken by Flores and her husband allegedly shows tiny bugs crawling around the sheets and purport to show bed bug bites on their bodies.
Emerald Princess Bed Bug Bites D503“Unbeknownst to Plaintiffs, the Stateroom was infested with hundreds of bed bugs,” the lawsuit says. “The bed bugs latched onto the Plaintiffs while they slept and sucked their blood until they were gorged,” the lawsuit says.
Flores and her husband suffered “numerous bites and skin rashes, which caused pain, discomfort, annoyance sleeplessness, inconvenience, humiliation, anxiety, and emotional distress,”, the lawsuit says. The couple notified the ship’s staff about the problem, but the “employees and medical staff refused and delayed Plaintiffs’ requests and ridiculed Plaintiffs and their injuries,” the lawsuit claims.
Cruise Bed Bug Allegations
“On or about November 29, 2018, and continuing for several days, Plaintiffs were aboard the vessel as fare-paying passengers assigned by Defendant to Stateroom D503 (hereinafter “Stateroom”). Unbeknownst to Plaintiffs, the stateroom was infested with hundreds of bed bugs. The bed bugs latched onto the Plaintiffs while they slept and sucked their blood until they were gorged. Plaintiffs suffered from numerous bites and skin rashes, which caused pain, discomfort, annoyance sleeplessness, inconvenience, humiliation, anxiety, and the presence of these filthy infestations aboard the vessel before Plaintiffs purchased their cruise even though Defendant had actual and/or constructive notice of the infestations. Moreover, the Defendant, by and through its agents, employees, and managers, intentionally concealed the bed bug infestation from Plaintiffs in order to induce them to purchase their cruise.
  • Plaintiffs reported these findings to Defendant and the medical staff aboard the vessel, requested prompt medical care and demanded to be moved to a new stateroom. Rather than promptly assisting Plaintiffs, Defendant through its employees and medical staff refused and delayed Plaintiffs’ requests and ridiculed Plaintiffs and their injuries.
  • Plaintiffs seek damages from Defendant for Defendant’s negligent, wanton, reckless and intentional failure to properly maintain pest control aboard the vessel and in the Stateroom and for allowing the bed bug infestation to occur and cause Plaintiffs to suffer financial loss, personal injury and emotional and mental distress.
  • As a direct and proximate result of the incident alleged herein and the negligent, wanton, willful, outrageous, reckless and intentional breaches of duties, acts and omissions of Defendant, Plaintiffs sustained serious illness and severe physical and emotional injuries, including but not limited severe skin rash, painful bed bug bites and personal injuries over the entirety of the body caused by bed bugs, aggravation of a pre-existing physical condition, emotional distress and mental suffering from insect bites, sleeplessness, inconvenience, humiliation, grief, frustration, anxiety and other symptoms, as well as property damage to clothing and personal belongings and out of pocket expenses. Plaintiffs are informed and believe, and thereupon allege that some or all of the injuries will result in permanent damage, disability, pain, and suffering, causing general damages in an amount within the jurisdictional requirements of this court.
  • As a further direct and proximate result of the incident alleged herein and the negligent, wanton, willful, outrageous, reckless and intentional breaches of duties, acts and omissions of Defendant, it was and continues to be necessary for Plaintiffs to receive medical and/or psychological care and treatment and upon information and belief Plaintiffs will be required to do so in the future. The cost of medical and/or psychological care and treatment past and future is not known at this time and Plaintiffs allege as damages herein the amount of such cost according to proof at trial.  emotional distress.
  • As a further direct and proximate result of the incident alleged herein and the negligent, wanton, willful, outrageous, reckless and intentional breaches of duties, acts and omissions of Defendant, Plaintiffs became incapacitated and prevented from following their usual occupation, and as a result thereof, Plaintiffs suffered a loss of earnings and earning capacity and other financial losses and are informed and believe and thereupon allege that they will suffer loss of future earnings and diminished earning capacity in the future in an undetermined amount. Plaintiffs allege as damages herein the amount of such past and future loss of earnings and earnings capacity in an amount according to proof at trial.”
