Carnival Valor Passenger Files Lawsuit After Casino Assault – On Monday, October 23, 2017, Horia Jordache from the Houston, Texas suburb of Needville, Texas was in the casino (see casino promo video below) aboard Carnival Cruise Line ship Carnival Valor when he was allegedly assaulted by another passenger, who was identified as Ty Walter, who is currently from the Dallas, Texas suburb of Kemp, Texas.

Carnival Valor embarked from Galveston,  Texas on a  7 Night Western Caribbean on Sunday, October 22, 2017.

The lawsuit,  [Horia Jordache v Carnival Cruise Lines] alleges,  “Defendant also owned, operated, managed, maintained, controlled, and/or supervised the bars, lounges, and other areas aboard CARNIVAL VALOR which sell and serve alcohol to passengers and owed its passengers, including Plaintiff, and had the legal duty to perform such functions in such a manner as to prevent them from being assaulted/injured by other passengers due to the influence of alcoholic beverages.”

“On or about October 23, 2017 and in the days leading up thereto, Defendant negligently, and in violation of its own policy, sold alcoholic beverages to an excess to a male passenger, Ty Walter. This occurred immediately before Mr. Walter assaulted Plaintiff and even after Mr. Walter had exhausted the number of drinks permissible under his drink plan.”

Plaintiff further alleges, “On or about October 23, 2017, Plaintiff was seated at the Casino Bar conversing with fellow passengers. A visibly and clearly intoxicated passenger, Ty Walter, had “maxed-out” his drink card with the daily 15 drinks limit, had gone to his cabin and retrieved his wife’s card, and then returned to the very same Casino Bar where he was knowingly served by the same bartender despite his obvious intoxication and despite the bartender knowing he were serving Mr. Walter him on a card which wasn’t his. In a visibly intoxicated state, Mr. Walter pushed himself between Plaintiff’s bar stool and that of a female passenger next to him and, without provocation or notice, violently struck Plaintiff in the back, knocking him to the floor and causing him to land hard on his right side. Despite calls for security, Mr. Walter was allowed to go on his way. Adding insult to injury, later in the cruise, concerned for his safety because Mr. Walter continued staring him down, not only did Defendant’s security team refuse to provide Mr. Walter’s name to Plaintiff, but, after advising Plaintiff that Mr. Walter’s drink privileges had been revoked, Plaintiff observed him being served alcohol by Defendant’s bar staff.”

“In the aftermath of Plaintiff’s assault, Defendant has failed to comply with its representations to Congress and its legal obligations under the Cruise Vessel Security and Safety Act, the Cruise Passenger Protection Act, 46 CFR Part 4, and other related legislation, to assist Plaintiff in prosecution of Mr. Walter. Moreover, upon information and belief, Defendant failed to complete and submit the required Cruise Line Report of Serious Violation of U.S. Law.

As a consequence, Plaintiff sustained injury to his right shoulder and right hip. As a consequence, Plaintiff has necessitated continued medical care following his
return home;  he sustained a SLAP tear of the right shoulder for which he requires surgery.”
